Note: This status report (below) has been superseded by our October 25 2021 status report.
We recently received notice that the Court will hear oral argument on COP’s Motion to Dismiss our Amended Complaint. LINK HERE. Previously we had filed an ex parte motion for oral argument. Under current federal rules, oral argument is completely discretionary with the judge. COP opposed oral argument, essentially writing that we have said it all. LINK HERE. The 12/10/2020 argument is via Zoom. We expect Laura Gaddy to attend. Thereafter, the Court will either deny or grant their motion, or deny in part and grant in part, in which case the losing side will most likely appeal.
